Terms of Use

These Terms of Use ("Terms") govern your access to and use of the LingoMate mobile application (the "App"), including LingoMate Offline Translations, and related services provided by LingoMate ("LingoMate," "we," "us," or "our").

Please read these Terms carefully. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy (also available in the App under Settings → Privacy Policy). If you do not agree, do not use the App.

1. Description of Service

LingoMate provides language translation and related features, which may include:

Text translation between multiple languages.
Voice translation using speech recognition.
Image translation using optical character recognition (OCR).
Chat-style translation for conversational use.
Offline language models that you may download to your device.
Free and paid subscription tiers with different features and limits.

Translation output is generated automatically and may not be accurate, complete, or appropriate for all purposes. The App is provided for general informational and personal use unless we agree otherwise in writing.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian.

By using the App, you represent that you meet these requirements and have the legal capacity to enter into these Terms.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use, as permitted by the App Store Terms and applicable law.

Except as expressly permitted, you may not:

Copy, modify, adapt, or create derivative works of the App.
Reverse engineer, decompile, or disassemble the App, except where prohibited by law.
Rent, lease, lend, sell, sublicense, or distribute the App.
Remove or alter proprietary notices.
Use the App for any unlawful purpose or in violation of these Terms.
Use automated means (bots, scrapers, etc.) to access the App without our permission.
Circumvent usage limits, subscription checks, or advertising requirements on the free plan.
Interfere with or disrupt the App, servers, or networks.

All rights not expressly granted are reserved by LingoMate and its licensors.

4. Subscriptions and Payments

4.1 Plans

The App may offer a free plan and paid subscription plans (for example, monthly and yearly Pro plans). Plan names, prices, and features are shown in the App and may change. Features may include unlimited translations, voice and image translation, chat translation, and removal of ads, as described at the time of purchase.

4.2 Billing through Apple

Paid subscriptions are processed by Apple through your Apple ID. By subscribing, you agree to Apple’s payment terms and Apple Media Services Terms and Conditions.

Payment is charged to your Apple ID at confirmation of purchase.
Subscriptions automatically renew unless you turn off auto-renew at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price.
You can manage or cancel subscriptions in Settings → [your name] → Subscriptions on your device.
Free trials or promotional pricing, if offered, convert to a paid subscription unless canceled before the trial ends.

4.3 Restore purchases

You may use Restore Purchases in the App to restore subscription entitlements associated with your Apple ID. Restored access depends on Apple’s records and your active subscription status.

4.4 Refunds

Refund requests are handled by Apple according to Apple’s policies. We do not control Apple’s refund decisions.

4.5 Price changes

We may change subscription prices where permitted by Apple and applicable law. Apple will notify you of price changes in accordance with its processes, and you may accept the new price or cancel before renewal.

5. Free Plan, Limits, and Advertising

On the free plan, the App may:

Impose daily or usage limits on translations (for example, a limited number of free translations per day).
After reaching certain limits, offer rewarded video ads to unlock additional translations (for example, watching a short video to unlock more translations for that period).
Display banner or other advertisements.

Advertisements are provided by third parties (such as Google AdMob). Your interaction with ads is subject to the advertiser’s and platform’s terms and policies. Upgrading to a paid subscription, where available, may remove ads and lift limits as described in the App.

6. User Content

You may submit content through the App, including text, voice, and images ("User Content"). You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to use, process, and transmit User Content solely as necessary to operate and improve the App (including providing translation, OCR, speech recognition, and related features), in accordance with our Privacy Policy.

You are solely responsible for User Content and must ensure you have all rights needed to submit it. Do not submit content that:

Violates any law or third-party rights (including privacy, publicity, copyright, or trademark).
Is defamatory, harassing, hateful, obscene, or otherwise objectionable.
Contains malware or harmful code.
Includes sensitive personal data you are not authorized to share.

We may remove or refuse to process User Content that violates these Terms or applicable law, but we are not obligated to monitor all User Content.

7. Acceptable Use

You agree not to use the App to:

Violate any applicable law or regulation.
Infringe intellectual property or other rights of others.
Transmit spam, unsolicited promotions, or deceptive content.
Impersonate any person or entity or misrepresent your affiliation.
Attempt to gain unauthorized access to the App, other accounts, or systems.
Use translations for high-risk purposes where errors could cause harm (for example, medical, legal, or emergency decisions) without independent verification by a qualified professional.

We may suspend or terminate access if we reasonably believe you have violated these Terms.

8. Intellectual Property

The App, including its design, software, text, graphics, logos, and trademarks (excluding your User Content), is owned by LingoMate or its licensors and is protected by copyright, trademark, and other laws.

These Terms do not grant you any right to use our name, logos, or branding without prior written consent.

Third-party components (such as Google ML Kit, Tesseract, Firebase, and Apple frameworks) are subject to their respective licenses.

9. Third-Party Services

The App relies on third-party services and technologies (including Google, Apple, and Firebase) as described in our Privacy Policy. Your use of those services may be subject to separate terms and policies. We are not responsible for third-party services outside our reasonable control.

The App may contain links to third-party websites or resources. We do not endorse and are not responsible for their content or practices.

10. Disclaimers

THE APP AND ALL TRANSLATIONS, CONTENT, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

Translations will be accurate, complete, or error-free.
The App will be uninterrupted, secure, or free of bugs.
Offline models or downloads will always be available or compatible with your device.

You use translations at your own risk. Always verify critical information with a qualified human translator or professional when accuracy matters.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

LINGUAMATE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP OR SUBSCRIPTIONS IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless LingoMate and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your User Content, or your violation of these Terms or applicable law.

13. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access if you breach these Terms or if we discontinue the App.

Upon termination, sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

14. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following also applies:

These Terms are between you and LingoMate, not Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App.
In the event of failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation.
Apple is not responsible for addressing claims relating to the App, including product liability, legal compliance, or intellectual property infringement.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary.

For subscriptions, you also agree to Apple’s applicable terms, including auto-renewal rules described in Section 4.

15. Changes to the App and Terms

We may modify, suspend, or discontinue the App or any feature at any time. We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date. If changes are material, we may provide additional notice in the App or as required by law.

Your continued use after the effective date of updated Terms constitutes acceptance, unless applicable law requires your consent. If you do not agree, you must stop using the App and cancel any active subscription through Apple.

16. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which LingoMate is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

Any dispute arising from these Terms or the App will be resolved in the courts of that jurisdiction, unless applicable law requires a different forum. Nothing in these Terms limits rights you may have as a consumer under mandatory local law.

17. General

Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and LingoMate regarding the App.
Severability: If any provision is held invalid, the remaining provisions remain in effect.
No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
